Other Aviation Legal Matters

In addition to FAA Enforcement Actions and NTSB Appeals Litigation, The Ison Law Firm also handles a variety of legal issues relating to aviation. Whether you need help buying or selling an aircraft, registering and titling your aircraft, defending the airworthiness of your aircraft, or fighting a TSA civil penalty, The Ison Law Firm can provide legal guidance to steer you in the right direction.

In the United States, a civil aircraft can only be registered when that aircraft is not registered under the laws of a foreign country and is owned by a citizen of the United States, a permanent resident alien, or a corporation organized under the laws of the United States. As you might imagine, the registering of an aircraft can be a complicated process. Questions arise when the owner of the aircraft is not a citizen of the United States. Consequently, you may need The Ison Law Firm to help sort out the legal issues associated with registering your aircraft.

The FAA revised the rule regarding the registration of aircraft on July 20, 2010, via “Re-Registration and Renewal of Aircraft Registration” under 14 C.F.R. § 47. All aircraft registered prior to October 1, 2010, must be re-registered with the FAA. As such, all aircraft registration now expires after 3 years and must be renewed. The FAA maintains that a 3 year renewal rate will decrease the likelihood of inaccurate information in their database.

Your aviation attorney at The Ison Law Firm understands the excitement surrounding the prospects of purchasing and selling aircraft. Unfortunately, your excitement may soon turn to disappointment if you realize that the aircraft you just purchased has a mechanic’s lien. Beyond that, certain FAA guidelines require the purchaser of an aircraft record the sale with the FAA Aircraft Registry records. Failing to record the conveyance of an aircraft could result in an invalid interest to third parties. Similar issues arise for aviators who import or export aircraft to and from the United States. If you require legal assistance during the sale or purchase of your aircraft, call the pilot lawyer at The Ison Law Firm.
